If the person is wrongfully convicted, he can sue the D.A (Pollock2011).The most ethical decision for the D.A to make in this case is to let the said burglar serve probation in the community. This is not only moral and ethically justified but it will be a win-win situation for both parties and especially if they told of the repercussions of pickings the case to trial (the victims may lose the case due to la ck of conclusive evidence or the burglar may be convicted of a abhorrence he did not
